Terms and conditions
These terms apply to arenacue.be and to paid ArenaCue subscriptions (Scoreboard, LED boarding and Signage) offered by Ploegaerts, Jason — trading as Sound and Vision / ArenaCue. Website information may change without notice. If an individual quote conflicts with this text, the quote prevails.
Demo and download
Demo requests are without obligation. A download, licence or commercial agreement only becomes active after confirmation by ArenaCue.
Subscriptions
Club Scoreboard and LED boarding are monthly Stripe subscriptions with two Windows activations per licence. Signage is billed per screen per month via the Signage dashboard. Site prices are exclusive of VAT; for consumers we also show the price including 21% Belgian VAT. A free 14-day Scoreboard trial is not a paid subscription and ends automatically.
When the contract starts
The paid subscription is formed when Stripe successfully processes the first payment. You then receive, by email on a durable medium, the licence key, the contract details, confirmation of your consents (terms and immediate performance) and the withdrawal information, plus customer-portal access and a Stripe confirmation. Until that payment, a request, demo or download is non-binding.
Automatic renewal
The subscription renews automatically each month for the same term at the then-current price until you cancel. Stripe attempts collection on the renewal date. If collection fails, Stripe may retry. While payment is outstanding we may temporarily block the licence. Access is restored after a successful payment.
Cancellation and refunds
You can cancel any time via the customer portal (Scoreboard/LED) or the Signage dashboard. Termination takes effect at the end of the period already paid. There is no minimum term. Prepaid periods are not refunded unless a mandatory rule requires it or we made an error that made the service unusable.
Price changes
If we change the price of an existing subscription, we give at least 30 days’ notice by email. You may cancel before the new price applies. A new price starts only from the next billing period.
Payment and arrears
Payment runs through Stripe. Businesses can enter a VAT number; invoices go through Stripe and/or onFact. If payment is overdue or collections keep failing, we may suspend access or end the subscription. That does not cancel amounts already due.
Usage rights and devices
You receive a non-exclusive, non-transferable right to use the desktop software while the subscription is active, on the number of Windows activations included in the plan (two by default). Extra devices, sharing keys or commercial resale is not allowed without a written agreement. Signage screens follow the screen count in your Signage subscription.
Processing of club data
For personal data that a club, venue or organiser enters or uploads into ArenaCue (player names, photos, media and Signage content) that customer is the controller. Ploegaerts, Jason (Sound and Vision / ArenaCue) acts as processor. We process those data only to provide the service, keep them as described in the privacy notice, use the sub-processors listed there, and delete or return them when the subscription ends unless a legal duty requires longer retention. The customer warrants a valid legal basis for what they enter. Data subjects should send access or erasure requests to the club first; we help the club with those requests.
Software
ArenaCue is delivered as Windows software. Available features, install options and updates may differ per version.
Updates, support and availability
While the subscription runs you receive software updates and email or chat support during ordinary office hours. ArenaCue is desktop software plus cloud services; we aim for a stable service but do not guarantee uninterrupted availability. Planned maintenance or failures at hosting, internet or your hardware are outside our control. An outage does not automatically create damages, but we will restore the service or, if the law requires it, grant a proportionate reduction.
Liability during live use
ArenaCue helps display scores, clocks, sponsors and screen content during matches. You as organiser remain responsible for a working setup (PC, screens, cabling, power, network and a trained operator) and for the accuracy of the data you enter. We are not liable for a missed match moment, a wrongly displayed score, a dropped screen, defective hardware or missed sponsor play, except in case of intent or gross negligence. For business customers (B2B) our liability for direct damage is limited to the amount you paid us in the twelve months before the event, except in case of intent or gross negligence. Towards consumers that cap does not limit mandatory statutory liability, including death or personal injury, intent or gross negligence, and the statutory rules on non-conformity of digital content or digital services. Mandatory consumer rights always prevail.
Intellectual property
The ArenaCue name, visual identity, texts and software remain the property of the rights holder unless agreed otherwise in writing.
Businesses and consumers
ArenaCue is aimed mainly at clubs, venues and other professional organisers. If you buy as a private consumer, mandatory Belgian and EU consumer rules prevail over this text. For consumers the total price including VAT is visible before payment.
Right of withdrawal
Consumers generally have 14 days to withdraw from an online contract, starting when the contract is formed. ArenaCue combines two things: (1) digital content — the licence key and the downloadable Windows software; and (2) digital services — the ongoing subscription, updates, licence checks and cloud features such as Signage. For digital content the withdrawal right can expire once delivery has begun, if you expressly requested immediate delivery before ordering and acknowledged that you would lose that right. For digital services the 14-day right generally remains; it is lost only when the service has been fully performed. If you ask us to start the service during that period you may still withdraw, but a reasonable pro-rata charge may apply for what has already been provided. Checkout asks for those confirmations. We then confirm them by email, together with the contract details, on a durable medium. The free trial is not an exercise of the withdrawal right and is separate.
Governing law and disputes
These terms are governed by Belgian law. Disputes belong to the courts of the district of Antwerp, Turnhout division, without prejudice to a consumer’s right to sue in the courts of their domicile.
Consumers may also submit a dispute to the Belgian Consumer Ombudsman Service or the European overview of alternative dispute-resolution bodies.
